Social Security Appeal Board

 

1. Social Security Appeal Board Scope of Work of Social Security Appeal Board

The Board is an independent body. Its main function is to provide a means of redress for any person not satisfied with the decision of the Social Welfare Department in respect of eligibility and payment of the Comprehensive Social Security Assistance (CSSA), Social Security Allowance (SSA) (comprising Old Age Allowance and Disability Allowance) and Traffic Accident Victims Assistance (TAVA) Schemes . Decisions of the Board are final, and do not constitute precedents.

An appellant may appeal in respect of any of the following matters :
  • the refusal of any payment;
  • the amount of payment offered;
  • the date from which payment was offered;
  • the issue of payment to a person other than the applicant.
  • 2. Appeal Procedures

    To lodge an appeal, the appellant is required to complete an appeal form (in either English or Chinese) and forward it to the office of:
  • the Social Security Appeal Board;
  • the Social Welfare Department Headquarters;
  • any of the Social Security Field Units;
  • the Traffic Accident Victims Assistance Section of the Social Welfare Department.

    An appeal must be lodged within four weeks from the date of notification of the decision from the Director of Social Welfare. Where an appeal does not involve the result of a medical assessment, the Board will normally hear the case within one month from the date of receipt of the appeal and notify the appellant in writing of the decision of the Board within three weeks after the hearing. Where the appeal involves the result of a medical assessment, the Board will arrange with the Hospital Authority for the applicant or recipient to undergo a medical assessment to be processed by a medical assessment board. The Board will notify the appellant in writing of its decision on the basis of the decision of the medical assessment board, normally within three weeks after the receipt of the decision of the medical assessment board.
